Q. If purchasing a property in Spain, is it legal to make the payment to the seller's account in another country?

    A. When buying property in Spain, it is legal to make payment anywhere in the world. I would say that security is the most important of issues in these cases, should the deal stall or fall through. As long as payment is established by any means, payment can be done anywhere.

    However, I recommend that payment for the purchase of a property in Spain is done to the seller in the country where the property is located. In fact, where the seller is a non-resident party, you should request that the downpayment is lodged with a third party, such as a lawyer (normally the sellerīs lawyer), in Spain. This account would operate as an escrow account, as the monies would only be released to the seller by his lawyer against transfer of free title to the property.

    Again, payment abroad is possible, but introduces new elements or risk, often quite distant to the location of the property, which makes their avoidance a wise decision.
